Refund policy
This returns and exchange policy (“this Policy”) for Refined Brands LLC d/b/a Naani’s LLC (hereinafter collectively referred to as “Naani’s,” “we,” “us,” and “our”) sets forth the terms and conditions under which orders may be returned, replaced or exchanged. By placing an order with us, you hereby agree to the terms of this Policy. This Policy does not apply to purchases made from third-party retailers.

Scope & Applicability. This Policy applies to all purchases made directly from the website and all subdomains of Naani’s, including, without limitation, mobile applications and any alternate customer channels (collectively, the “Site(s)”).

Damaged or Defective Products. If you receive a damaged or defective product, we will offer a replacement. If your order arrives damaged or defective, you may submit a claim by contacting us at hello@drinknaanis.com, providing your order number and clear photographic evidence of the damaged or defective product and its packaging (e.g., broken seals, crush, scuff or abrasion damage, product leakage, broken or torn packaging, etc.) within seven (7) days of Delivery. “Delivery” occurs when the carrier records the order as delivered to the address you provided at checkout.
Once we have confirmed that your product was damaged or defective, we will provide you with instructions for initiating a replacement. Customers are not required to return any damaged or defective items.

Unwanted or Non-Defective Products. Except where prohibited by law or expressly permitted by us in writing, we do not accept returns, nor offer refunds, replacements and/or exchanges for products that are not damaged or defective.

Supply Charges; Title & Risk. Original supply charges are non-refundable unless we determine the issue was due to our efforts. Except where prohibited by law, title and risk of loss pass when we transfer the products to the carrier. We are not responsible for theft or loss after Delivery.

Pricing Adjustments & Promotions. Price adjustments are not offered for prior purchases unless expressly stated in a promotion’s terms. If a replacement or exchange involves a promotional bundle or discount, such replacement or exchange may be adjusted to reflect the promotion’s terms.

Policy Abuse, Excessive Claims, & Fraud Prevention. We strive to resolve issues fairly and in good faith. To protect our customers, we reserve the right to refuse any replacement or exchange, and to suspend or terminate accounts where we, in our reasonable judgment, detect suspicious activity, excessive claim patterns, policy abuse, or fraud. We may require additional documentation, deny requests, or limit future transactions.

Wholesale, Corporate, or Bulk Orders. Replacements and exchanges for wholesale, corporate, or bulk orders may be subject to different terms agreed to in a separate writing or policy. Absent different terms, this Policy applies, and we reserve the right to impose different conditions, timelines, and fees for such orders.

Disclaimers & Limited Warranties. To the fullest extent permitted by law, we provide products “as is” and “as available,” and disclaim all express or implied warranties not expressly set forth in this Policy, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow limitations on implied warranties; in those jurisdictions, these disclaimers apply only to the extent permitted by law.

Limitation of Liability. To the fullest extent permitted by law, our total liability for any claim arising out of or related to a purchase, replacement, exchange, or this Policy shall not exceed the amount you actually paid for the product giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost funds or data, even if advised of the possibility of such damages. These limitations do not apply where prohibited by law.

Changes to the Policy. We expressly reserve the right to update, modify or otherwise change this Policy from time to time. Any such updates, modifications or changes will be effective immediately upon being posted, unless otherwise stated. The version of this Policy posted on our website at the time of your purchase will govern.

Governing Law. This Policy and any disputes arising out of or relating to your purchase shall be governed by, and construed and enforced in accordance with the laws of the State of Ohio, without regard to the conflicts or choice of laws provisions thereof.

Waiver. Any failure by Naani’s to exercise or enforce any rights under this Policy shall not constitute a waiver of those rights.

Severability. In the event that any provision of this Policy is found invalid or unenforceable, such provision shall be considered deleted from this Policy and the remaining provisions shall remain in full force and effect.
