This site is operated by Refined Brands LLC d/b/a Naani’s LLC and its affiliates, subsidiaries, and parent companies (hereinafter collectively referred to as “Naani’s,” “we,” “us,” and “our” through this Policy). Your privacy is important to us, so we’ve developed this Policy (this “Policy”), which is designed to advise you about how we collect, disclose, transfer and otherwise use (collectively, the “Process”) the Personal Data (as defined below) that you share with us when you visit or make a purchase from any of our websites and online services, including, without limitation, drinknaanis.com and our Facebook, Instagram, TikTok and other social media or interactive pages that link to this Policy (collectively, the “Site”). By visiting the Site, ordering our products or using our services, you are accepting the practices described in this Policy, as modified from time to time by us in our sole discretion. Your continued use of the Site after we make changes is deemed to be acceptance of those changes, so please take a moment to read through this Policy in its entirety and check back from time to time so you are aware of any changes or updates made hereto.

  1. What Information is Collected.

We act as the controller of the Personal Data we gather through your use of our Site. When you visit the Site, we automatically collect certain information about your device, including information about your web browser type and version, operating system, screen resolution, internet protocol (IP) address, language, time zone, and some of the cookies that are installed on your device, and, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site (collectively, “Device Information”).  We may also collect information relating to an identified or identifiable natural person (“Personal Data”), which includes, but is not limited to, name, approximate geolocation, and securely processed payment method information that can be used to directly or indirectly identify a natural person. When used in this Policy, “Personal Data” shall refer collectively to Device Information and/or Order Information.

We collect certain aggregated information from our users when they visit the Site. Aggregated information does not relate to a single, identifiable visitor. It tells us how many users visited the Site and/or what pages thereof were accessed.

We also collect certain non-personal information when you visit the Site.   1. How Your Personal Data is Used.

The Personal Data we collect may be used for the following purposes: 

  • To fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations);

We will only collect and Process Personal Data about you where we have lawful bases (“Lawful Bases”), which includes, but is not limited to, (i) consent (where you have given consent), (ii) contract (where processing is necessary for the performance of a contract with you, and (iii) other commercially reasonable interests. Where we rely on your consent to Process Personal Data, you have the right to withdraw or decline your consent at any time.   1. Sharing Your Personal Data. 

In order to provide you with our Site, we work with third-party service providers who operate certain content and features to process and store your Personal Data. These third-party service providers will only collect, use and disclose your Personal Data to the extent necessary to allow them to perform the services they provide to us. We do not disclose your Personal Data to our service providers. We do, however, make use of social media plugins to direct you to our social media channels and to allow you to interact with our content. These social media channels are listed below.

Also note that certain third-party service providers may be located in or have facilities that are located in different jurisdictions. Please also keep in mind that if you leave the Site or are redirected to a third-party website or application, you will be subject to the terms of such third-party website and you are no longer governed by this Policy or our Terms of Use, even if you accessed the third-party website through a link on the Site.

We may also disclose your Personal Data in the event such disclosure is required or necessary in order to fulfill a legal obligation, including but not limited to, to comply with applicable laws and regulations, to respond to a subpoena, search warrant, court order or other lawful request for information we receive, or otherwise to protect our rights. We may also disclose Personal Data in order to protect your vital interests or the vital interest of another natural person. For the avoidance of doubt, we have never, nor will we ever, sell your Personal Data.

If you are a European Economic Area (“EEA”), United Kingdom or Switzerland resident, your privacy rights are not governed by this Policy, but instead are governed by the following terms:

  1. Transfers: Information we collect may be transferred to, and stored and processed in, the United States or any other country in which we or our affiliates or subcontractors maintain facilities. To the best of our knowledge, we do not meet any of the legal thresholds which would subject us to the California Privacy Rights Act (“CPRA”). In the event we do meet the legal threshold which would subject us to the CPRA, we shall act in accordance with the CPRA. 

  1. Our Data Retention Policy.

Your Personal Data will not be kept for longer than is necessary for a specific purpose. However, considering it is not possible for us to specify a period in advance, the period of retention will correspond to our efforts to do the following:

  • To provide you with information, products or services that you request from us or which we feel may interest you;

  • To carry out our obligations arising from any contracts entered into between you and us, including for billing and collection;

  • If you pay for services or goods using a credit card, we will transmit your credit card data to the appropriate credit card company and/or credit card payment processing company;

When you place an order through the Site, we will maintain your Order Information for our records unless and until you request we delete your Personal Data in accordance with this Policy. In the event you withdraw your consent or you object to our use of your Personal Data, and such objection is successful, we will remove your Personal Data from our databases. Please note that we will retain the Personal Data necessary to ensure your preferences are respected in the future.

As an exception, we will not delete your Personal Data where we still have a legitimate interest to use your Personal Information, such as enforcing our Terms of Use located at drinknaanis.com, resolving disputes, or otherwise complying with our legal obligations, in order to file a legal claim or defend ourselves against a legal claim, or for evidentiary purposes.

  1.  Changes to Our Privacy Policy. 

From time to time, we reserve the right to modify or otherwise change this Privacy Policy in order to reflect changes to our practices or for other operational, legal or regulatory reasons. Any such modifications or changes will be effective immediately upon being posted, unless otherwise stated in the change. You will always be able to consult the most recent version of the Privacy Policy on our Site.

  1. Trademark Rights.

We and our affiliates, licensors and content providers are the owners of all the trademarks used on the Site.  Third parties are not allowed to sell products that use or apply any of our trademarks, logos and identifying marks without our express written consent.

  1.  Children’s Guidelines.

Visitors to the Site must be at least eighteen (18) years of age and otherwise above the age of majority in their state, province or country of residence (the “Required Age”). Individuals under the Required Age should not submit or post any information on the Site. Without limiting the foregoing, the Site is not intended for any person under the Required Age. No one under the Required Age may provide any information to or on the Site. We do not knowingly collect personal information from individuals under the Required Age.
